Information for validation and verification bodies acting under the German Upstream Emission Reduction Ordinance (UERV)

To facilitate the processes of validation and verification, we want to highlight specific requirements regarding any significant adverse effects on issues laid out as per the preamble of the Agreement on 12/12/2015 (BGBl. 2016 II S. 1082, 1083 – “Paris Agreement”) within the host country. Please see the current German version that is the legally binding text.
Please be advised to comply with all requirements laid out in the German “Verordnung zur Anrechnung von Upstream-Emissionsminderungen auf die Treibhausgasquote (Upstream-Emissionsminderungsverordnung - UERV), including Sec. 40 Nr. 14 UERV and Sec. 41 Nr. 7 UERV, Lead Partners of project activities are required to produce the relevant information as per Sec. 7 II Nr. 2 c) and Sec. 9 Nr. 8 UERV.
Proceedings under the UERV
When applying for approval of a project activity under the Upstream Emission Reduction Ordinance (UERV), you are required to provide a statement, whether or not the project activity has significant adverse effects on issues laid out as per the preamble of the Paris Agreement within the host country. The statement must take the specificities of the relevant region within the host state into account. As per Sec. 7 II Nr. 2 c) and Sec. 9 Nr. 8 UERV these statements must be provided within the project design document and must be part of the monitoring plan. The statement must be validated by the validation body as per Sec. 40 Nr. 14 UERV.
The information needs to be part of the PDD and the validation report. In case the reports are already submitted to the German Environment Agency, the clarifying information needs to be provided within an updated PDD. It needs to be validated and incorporated in the validation report. The updated validation report needs to be signed by the validation body and submitted as a pdf document. It would be helpful to receive the validation report as well in a version, where the changes are highlighted.
When applying for a change of the lead partner of a project activity as per Sec. 17 IV UERV, the compliance with this requirement will be assessed by the German Environment Agency as well.
During verification, as per Sec. 41 Nr. 7, the compliance with this requirement has to be assessed and confirmed by the verification body as well within the verification report.
