Cessation of operations

A cessation of operations of an installation occurs according to Article 10(19) EU Emissions Trading Directive (EHRL) and Article 26 EU Allocation Regulation when either the emission permit has expired, the installation no longer meets the thresholds of the activities listed in Annex I EHRL or operations have ceased and cannot be resumed for technical reasons.

A cessation of operations of an installation must be notified to DEHSt immediately via the separate FMS application ‘Notification of cessation of operations 2021-2030’ accompanied with substantial evidence (e.g. a determination notice by the State (Land) Authority). This notice does not require verification.

A cessation of operations associated with the discontinuation of the emissions trading obligation must be notified even if the installation does not receive a free allocation.
You can also declare a waiver of allocation for your installation in the FMS application ‘Notification of cessation of operations 2021-2030’ in accordance with Article 24 Allocation Regulation EU ZuVO.

Part 5 of the ‘Guideline for the Allocation Procedure 2021-2030’ explains the regulations and notification obligation for adjusting the allocation quantities in the event of cessation of operations, discontinuation of the emissions trading obligation and the waiver of allocation for the installation.
