Greenhouse Gas Emissions Trading Act and Emissions Trading Ordinance 2030
The European Emissions Trading Directive (ETSD) as amended on 05/06/2023 provides the legal framework for the second allocation period of the 4th trading period from 2026 to 2030. In Germany, the EHRL is implemented by the Greenhouse Gas Emissions Trading Act (TEHG), which is adapted to the current version of the EHRL. Further German regulations concretising the TEHG and the allocation rules are set out in the Emissions Trading Ordinance 2030 (EHV 2030). The TEHG and the EHV 2030 are currently still in the legislative process. We will provide links to these legal texts once they have come into force.

Information and regulations of the European Commission
The EU Allocation Regulation (EU Allocation Regulation, Delegated Regulation (EU) 2019/331, Official Journal of the European Union L 59 of 27 February 2019, page 8) has been amended for the second allocation period of the fourth trading period. The amendment was published as Regulation (EU) 2024/873 in the Official Journal of the European Union (L series of 4 April 2024). It defines the EU-wide allocation rules, including the provisions on the application procedure, the scope of the data required and the methodological approach for the second allocation period. The regulation is binding and applies in every member state. It is therefore aimed directly at installation operators, verifiers and competent authorities.
The European Commission may adopt further legal acts for the second allocation period in the fourth trading period. In particular, we expect the Accreditation and Verification Regulation (AVR), which sets out the requirements for the verification of allocation applications, to be amended.
Furthermore the Commission has published new versions of the so-called guidance documents, in which it provides extensive explanations of the allocation rules and data requirements and also on the topics of energy efficiency and climate neutrality plans.

Provisional allocation amounts for the second allocation period (2026 to 2030)
Here you will later find the so-called NIMs list (NIMs = National Implementation Measures) in accordance with Article 14 of Delegated Regulation (EU) 2019/331 (EU-ZuVO). The NIMs list contains the provisional allocation quantities for existing stationary installations in Germany for the second allocation period 2026 to 2030. It does not include new market participants and installations that will participate in emissions trading in the second allocation period of the fourth trading period but will not receive an allocation, or aircraft operators.

National Allocation Table (NAT)
Here we will later publish the so-called National Allocation Table which will show the allocation quantities to all installations following approval by the Commission.
